A judge in Colombia used the AI software ChatGPT in a medical rights case involving a child diagnosed with autism spectrum disorder (ASD).

Judge Juan Manuel Padill, who is overseeing the case in Cartagena, used the OpenAI tool to determine whether the boy would be exempt from medical expenses. Including transportation, according to Colombian Radio station Blu Radio.

Padilla asked the ChatGPT tool a series of questions to verify relevant information in the case.

He said that under Colombia’s Law 2213 of 2022, judges can sometimes use AI software to help make decisions.

The radio station published a transcript of the question and answer between Padilla and ChatGPT, in which the judge asked: “Can autistic people be treated without paying medical fees?”

ChatGPT replied, “Yes, no fee. Under Colombian regulations, minors diagnosed with autism can be treated without paying medical fees.”

ChatGPT clarified that Law 1753 of 2015, which provides this benefit, “applies to all institutions providing public or private medical services to those receiving assistance from the Social Security medical system”.

Padilla told Blu Radio that using ChatGPT helped save time. And told Britain’s Guardian newspaper that it helped “facilitate the drafting of the text.” But he added that ChatGPT was not used “to replace” judges. ChatGPT, he argues, can “shorten the response time” of the justice system and provide information “in an organized, simple and structured way”.

ChatGPT did support Padilla’s ruling that the child’s medical expenses would be covered by his medical plan because his parents could not afford it.

While the ruling was not opposed. The judge’s use of ChatGPT in the case drew criticism from others who argued that AI had no place in the courtroom.

ChatGPT was released to the public in November. And in just two months Chatgpt has captured the hearts of 100 million users, making it the fastest growing app of all time.

Professor Juan David Gutierrez of the University of Rosario in Bogota tweeted on Tuesday that the AI tool could “return incorrect, inaccurate, false results”, leading to decisions that could be the opposite of those made by judges and secretaries looking at the information themselves.

Despite the criticism, Justice Octavio Tejeiro of Colombia’s Supreme Court praised Padilla’s decision to use ChatGPT. He told the Guardian that the justice system “should make full use of technology as a tool”. “AI must be seen as a tool to help judges improve their judgment,” he added.
