员工上网行为管理不是什么新鲜的事物,十几年前就有了。
只是随着技术的发展,现在越来越精细化了,只要员工连上公司提供的网络,员工在网上的行为,在企业那边基本是透明的。
检测员工跳槽倾向算是员工上网行为管理软件在hr领域的应用,这也不是什么高明的技术,作为提供网络给员工使用的企业方,理论上员工任何发送和接受到的数据都可以被抓取到,包括微x等社交工具的聊天内容,。
只是这两年该类型产品的报表越来越详细了,员工访问求职网站次数、聊天关键词、以及简历投递次数,都可一目了然。通过这个强大的报表分析,企业可以比较容易的看出来最近哪些员工有跳槽的想法。
网络流传比较广的是这张图片,不过这张图应该是IT厂商搞的测试图片,因为网传该图片出自知乎内部截图,经数字化转型网核实,知乎并没有这个客户导向部的部门,整个事件看起来更像是厂商为了推广自己的产品,搞的事件营销,一个假新闻或者捕风捉影的公关炒作。
关于这个疑似假新闻事件的文章里面充斥着炒作的软广告,不少流传甚广的文章到处都是该产品很神奇,行业占有率高、上市公司研发,大企业都在用,价格便宜3年仅需一点点钱、功能介绍、客户案例等字眼的“销售卖点”。
国美部署过该类系统,之前一份《关于违反员工行为规范的处罚通报》内部文件曾登上社交平台热搜。通报文件称,根据相关规定,国美员工在办公区域禁止从事与工作无关之事,比如,玩电脑游戏、上网聊天、听音乐等。这份处罚书包含了员工的所在部门,姓名,甚至后台的非工作流量情况。
一、使用该类产品的企业比如国美违法吗?
先不谈违法不违法的问题,缺少人情味,缺少人文关怀是真的。这和之前被曝光的某家企业规定上厕所时间性质差不多,如果一家企业要靠监视员工这种手段,而不是首先考虑如何改善管理手段提升绩效提升员工积极性的话,估计不是走下坡路也离倒闭也不远了。
根据数字化转型网的律师顾问底敏(德恒上海律师事务所)的意见,即使告知了员工,收集员工在上班时候的互联网行为数据,仍然可能违反《个人信息保护法》,企业处理员工个人信息,需要向员工告知处理目的、方式、种类、期限等(第17条),并获取员工个人同意或是基于人力资源管理所必需(第13条),但判断离职很难被认定为人力资源管理必需。
如果公司没有告知,或者告知不够清晰,在个人信息保护越来越受重视的中国,更是随时有可能吃劳动官司赔钱,声名狼藉。
所以啊,各位IT经理、IT总监、CIO在安装这种软件的时候一定要谨慎,毕竟企业吃官司了被舆论一边倒的骂了,背锅的还是广大IT同仁们。
如果没有告知其他同事,可能会危及自己的人身安全:哪天因为打小报告,回家路上被其他部门同事揍一顿也是有可能的。
二、研发和销售此类产品的IT软件厂商违法吗?
不违法,卖刀的从来都不违法,只要刀符合生产标准。刀用的不是地方会违法。
但无论是搞假新闻炒作还是蹭负面新闻的热点,市场公关部门都是玩火自焚,流量有了,名声坏了,即使这样的监管系统采购买单的是企业和老板,普通员工没啥关系话语权,但是甲方企业现在哪个不标榜“人文关怀、尊重员工”,招致白领雇员们反感一致声讨的软件产品系统,企业上了这个产品恐怕离职率反而要飙升了,HR招人更困难了,毕竟没有人愿意待在“东厂西厂锦衣卫”的环境里。
