1、希望OpenAI回归成立初心,把AI技术开源;
2、希望OpenAI把违反合同期间挣的钱都要还回来,且要对其使用捐赠款项的情况进行清查;
(四)与上述(一)至(三)项一致并实施的禁令救济;

Burst! Musk is going to court against OpenAI and its co-founders Sam Altman and Greg Brockman? !
In the technology circle, after the “palace drama” in the sudden ouster of Sam Altman, the father of ChatGPT, another Silicon Valley “surprise big melon” was exploded.
On March 1, Tesla CEO Musk filed a 46-page lawsuit in San Francisco Superior Court, accusing OpenAI, its co-founders Sam Altman and Greg Brockman, and OpenAI’s management of violating the non-profit mission promised by the original company when it was founded in 2023. Established an exclusive partnership with Microsoft, violated fiduciary duties, contractual agreements and unfair business practices, and turned to closed source and started making profits instead of open source code for advanced AI technology after ChatGPT, Sora and other products became popular.
So why is Musk so angry? This goes back to the creation of OpenAI.
In December 2015, OpenAI was founded by Elon Reeve Musk (CEO of Tesla), Sam Altman, Greg Brockman, Reid Hoffman and others, and at that time Musk, Sam Altman and others were co-founding non-profit organizations. Elon Reeve Musk and Sam Altman were original board members.

Between 2016 and September 2020, according to the lawsuit, Musk donated more than $44 million to OpenAI during this period, and in addition to financial support, Musk also provided corresponding advice on OpenAI’s research direction, as well as efforts to recruit top scientists and engineers.
In 2018, Elon Reeve Musk resigned his seat on Tesla’s board of directors, citing “potential conflicts of interest in the future” as Tesla’s chief information officer. Altman claimed that Elon Reeve Musk wanted to take over OpenAI himself because he believed that OpenAI had fallen behind other companies such as Google (Google), but the board refused to resign.
From July 2019 to 2020, thanks to Microsoft’s funding and technical support, several versions of ChatGPT released by OpenAI have also attracted widespread attention in the industry.
In July 2023, Elon Reeve Musk announced on the social platform that xAI, an artificial intelligence company, was officially established, and xAI’s core team members had worked in DeepMind, OpenAI, Google Research, Microsoft Research, Tesla and other well-known enterprises.
If you are concerned about Musk’s friends will also notice that over the years, Musk often expressed his dissatisfaction with OpenAI’s transformation of commercial profit and closed source model on the social platform, and made sarcastic remarks about OpenAI’s cooperation with Microsoft.
What will Musk be asking for in the 46-page, 14,000-word lawsuit?
It can be summarized as follows:
1. I hope OpenAI will return to its original intention and open source AI technology;
2. Expect OpenAI to return all the money earned during the breach of contract, and to check its use of donated funds;
Of course, Musk also calculated all kinds of interest and legal fees clearly, which can be said to be a thorough “liquidation” of OpenAI and Sam Altman. The following is the original text of the 10 major and 11 minor items listed in Musk’s lawsuit that he ultimately wants the court to decide against OpenAI: The plaintiff seeks the following judgment against the defendant:
(1) to seek a court order to enforce contractual commitments breached by the defendant, including but not limited to: 数字化转型网(www.szhzxw.cn)
1) Require Defendants to continue to follow OpenAI’s longstanding practice of making AI research and technology developed at OpenAI available to the public.
2) Defendants are prohibited from using OpenAI or its assets to serve the financial interests of individual Defendants, Microsoft, or any other specific person or entity.
(2) Require the Justice Department to determine that GPT-4 has de facto become AGI and is therefore outside the scope of OpenAI’s license to Microsoft.
(3) to ask the judiciary to determine that Q* and other OpenAI next generation large language models under development are AGI and therefore beyond the scope of OpenAI’s license to Microsoft.
(4) injunctive relief consistent with items (1) to (3) above and implemented;
(5) require the return or forfeiture of all monies received by the defendant during the period in which he engaged in the unfair and improper conduct described herein, in addition to pre-judgment interest and fines, in accordance with, inter alia, Section 17200 of the Business and Professions Code.
(6) An accounting of funds donated by Plaintiff and others to OpenAI, intellectual property rights or derivative works funded therefrom, and the use of donated funds by Defendant for personal benefit or for the benefit of any individual or third party entity.
(7) Seek general and punitive damages proven at trial, each of which the plaintiff will donate to a non-profit organization or charity.
(8) Attorney’s fees under Section 1021.5 of the California Code of Civil Procedure.
(9) Pre-judgment and post-judgment interest for the maximum legal interest rate.
(10) to request such other and further relief as the court deems just and appropriate. With the fame of ChatGPT, and then to the recent global hot Sora, OpenAI has been at the forefront of the global technology industry, and every move of OpenAI has affected the eyes of people from all walks of life.
Some time ago, the “AI face change” fraud case, the original link: Men participate in multiple meetings, only they are real people!
At the same time as the continuous development and innovation of new technologies related to artificial intelligence (AI), attention has also been paid to the problems brought about by the safety and ethics of artificial intelligence (AI), so how to balance the relationship between AI security and the rapid development of technology has also become a hot topic of attention and discussion.
So from this lawsuit document we can also see that Musk sued OpenAI for the reason is also out of concern for AI safety, but behind whether there is still a reason for its development, we can not speculate.
Musk’s lawsuit against OpenAI is scheduled for a case management conference on July 31, 2024.
So where does this entanglement between Musk and OpenAI go from here? Will this public lawsuit reveal the real answers behind Sam Altman’s power grab and mysterious Project Q? We will keep an eye on…
